Anglican Church disputes HK$180m profits tax bill

The Anglican Church alleges collectors used the wrong date to calculate tax on a HK$1.119 billion profit from a property project, causing it to be overcharged millions of dollars.

The Hong Kong Sheng Kung Hui and its foundation were billed more than HK$180 million by the Inland Revenue Department in 2008 for profits tax involving its Tai Po Deerhill Bay project. The church is seeking to overturn a lower-court ruling rejecting its claim that the tax should be waived because the money was used for charity.

But even if the development is deemed a business rather than a charity project, the church's lawyers told the Court of Appeal yesterday, the tax should be reduced because the department had calculated it from too early a date.
